By accessing or using Momentum (“the Service”), you agree to be bound by these Terms of Service. If you don’t agree with these terms, please don’t use our service.
3. About Momentum
Momentum is a template-based motion graphics editor that lets you create animations by selecting templates, adding your images, and adjusting parameters through sliders. You can then export your completed animations.
4. User Accounts
You must create an account to use Momentum. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and confidential
- Not share your account credentials with others or allow others to use your account
- Notify us immediately of any unauthorized account access
- Be responsible for all activities under your account
We may suspend or terminate accounts that violate these terms.
5. Acceptable Use
You may use Momentum to create motion graphics for legitimate purposes. You agree not to:
- Upload content that infringes on others’ intellectual property rights
- Create content that is illegal, offensive, or harmful
- Attempt to reverse engineer, hack, or disrupt the service
- Share your account credentials with others
- Use the service to create spam or misleading content
Indemnification: You agree to defend, indemnify, and hold harmless Uninspired Studios, its owners, and affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising from your violation of these terms or your infringement of any third-party rights.
6. Content and Intellectual Property
Your Content
- You retain ownership of images and other content you upload to Momentum
- You grant us a limited license to process your content to provide the service
- You’re responsible for ensuring you have rights to use any content you upload
Our Templates and Tools
- All templates, whether free or paid, remain our intellectual property
- When you purchase a template, you receive a license to use it for creating animations
- The Momentum software and interface remain our intellectual property
Exported Animations
- Commercial use: You may use animations created with our templates (free or paid) for commercial purposes, including in marketing materials, client projects, social media, websites, and presentations
- You may not resell, distribute, or sublicense the template files themselves or exported animations as templates or other stock assets.
- Exports. You own your finished exports as part of your larger work, subject to third‑party rights you include (fonts, images, music, etc.).
- Ownership: You own the rights to use your exported animations according to these license terms
- Templates. When you purchase a template, we grant you a non‑exclusive, non‑transferable, worldwide, perpetual license to use it to create end‑product animations for yourself or clients. Unless stated otherwise, one license is single‑seat (one natural person).
7. Privacy and Data
Data We Collect
We collect and use your information as described in our Privacy Policy.
Data We Don’t Store
Important: We do not store your project files, uploaded images, or work-in-progress animations on our servers. All content processing happens locally in your browser. When you upload images or work on projects, this data remains on your device and is not transmitted to or stored on our servers. When you close Momentum, your work is not saved on our servers unless you explicitly export and save it to your own device.
Data Backup Responsibility
Since we don’t store your projects, you are solely responsible for saving and backing up your work. We recommend regularly exporting your animations and saving project files locally.
8. Payment and Billing
Merchant of Record
https://www.paddle.com/legal/checkout-buyer-terms
Payments are processed by Paddle as our Merchant of Record. You purchase from Paddle; we license the template to you. The Paddle Buyer Terms apply to the payment portion of your transaction and govern tax (VAT/GST), refunds, and chargebacks.
All payments for Momentum subscriptions, templates, and other services are processed by Paddle.com Market Limited (Paddle) as our Merchant of Record. Paddle is responsible for:
- Processing all payments and transactions
- Handling billing inquiries and payment disputes
- Managing refunds in accordance with their policies
- Collecting and remitting applicable taxes
- Providing receipts and invoices
When you make a purchase, you are entering into a transaction with Paddle, and Paddle’s terms of service and privacy policy apply to the payment processing portion of your transaction.
Purchases
- All purchases are one-time payments for templates and other digital products
- You authorize Paddle to charge your selected payment method for the purchase amount
- Once purchased, you have ongoing access to your templates according to the license terms
Refunds
For Refunds see our Refund Policy Page.
9. Service Availability
We strive to keep Momentum available, but we don’t guarantee uninterrupted access. We may need to perform maintenance or updates that temporarily affect service availability.
No Cloud Storage
Local‑only processing. Momentum renders projects locally in your browser; we do not store project files or uploads on our servers. You are responsible for saving/backup of your exports. This does not limit our legal obligations regarding your account or billing data, which we process as described in our Privacy Policy.
10. Limitations of Liability
Momentum is provided “as is.” We’re not liable for any damages arising from your use of the service, including but not limited to lost profits, data, or business opportunities.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence, we are liable only for breaches of essential contractual duties (“Kardinalpflichten”), limited to the typical, foreseeable damage at the time of contracting. Any further liability is excluded. Contractual guarantees, if expressly given, remain unaffected. (This clause is designed to comply with BGB §309 No. 7.)
11. Termination
We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us.
Upon termination:
- Your access to purchased templates will be revoked
- Since we don’t store your projects or uploads, there is no user data to delete beyond your account information
- These terms will continue to apply to any exported animations you created before termination
You may close your account at any time. We may suspend or terminate for material breach. Upon termination for convenience (by you) or for reasons not caused by your breach, your existing licenses and exported works remain valid. We may revoke licenses obtained by fraud or material breach.
12. Changes to Terms
We may update these Terms. For material changes, we’ll notify you by email at least 30 days in advance. If you continue using Momentum after the effective date, you accept the revised Terms. If you object and are an EU consumer, we’ll explain your options under applicable law (including any right to terminate).
13. Governing Law
These terms are governed by German law. Any disputes arising from these terms will be subject to the jurisdiction of German courts.
